Terms and Conditions

A. Service Rendered: SOMI Roll Off agrees to furnish the solid waste collection and disposal services as specified and the Customer agrees to make the payment(s) as provided for herein and abide by the terms and conditions of the Agreement.


B. Waste Material: The waste material to be collected and disposed of by SOMI Roll Off pursuant to this Agreement is a solid waste generated by Customers excluding radioactive, volatile, highly flammable, explosive, toxic, or hazardous material. This includes, but not limited to, appliances, tires, tree stumps, oil drums, and toxic material. 10 Cubic yard "low boys" are designed for inert materials only: rock, concrete, bricks, and clean dirt (NO grass and roots). The term “hazardous material” shall include, but not be limited to, any amount of waste listed or characterized as hazardous by the United StatesEnvironmental Protection Agency or any state agency pursuant to the Resource Conservation and Recovery Act of 1976, as amended, or applicable state law. SOMI Roll Off shall acquire title to the waste material when it is loaded into SOMI Roll Off trucks. Title to and liability for any waste excluded above shall remain with Customer, and Customer expressly agrees to defend, indemnify and hold harmless SOMI Roll Off from and against any and all damages, penalties, fines, and liabilities resulting from or arising out of such waste excluded above.

C. Liability for Equipment: Customer acknowledges that it has the care, custody, and control of equipment owned by SOMI Roll Off and accepts responsibility for the equipment and its contents except when it is being physically handled by employees of SOMI Roll Off. Therefore, Customer expressly agrees to defend, indemnify and hold harmless SOMI Roll Off from and against any and all claims for loss of or damage to property, or injury to or death of person or persons, resulting from or arising in any manner out of Customer’s use, operation or possession of any equipment furnished under this agreement.

D. Damage to Property/Pavement: Customer acknowledges that SOMI Roll Off shall not be liable for any damages to pavement, curbing, or driving surface resulting from its trucks servicing in agreed-upon areas. SOMI Roll Off is not responsible for any damage(s) that may occur to the customer property as directed by the customer.

E. Dumpster Fill: All materials must be loaded level and cannot exceed the top of the dumpster or stick out from topsides. Additional fees will apply for the overage of the agreed-upon tonnage. Fill the container with even weight distribution as best as you can. Avoid dumping inert material in our 40 Cubic yard containers, such as rock, concrete, or dirt. Our 10 Cubic yard "lowboy" container is meant for inert material such as dirt, concrete and brick. The presence of other materials including trash, wood, glass, plastic, metal constitutes a contaminated load and SOMI Roll Off will assess a contamination charge per each ton for the 10 Cubic Yard “lowboy”. It cannot exceed 10 tons of waste, total. SOMI Roll Off can refuse the right to haul any container if the container exceeds the weight limit. All sizes are approximate measurements in cubic yards.  

F. Street Permit: The customer is responsible for the street permit if a permit is required.

G. Duration: Dumpster rentals are between 1-7 days. The customer shall call when ready for pick-up between the duration of the rental. Any rental exceeding 7 days will be charged a daily rate of $50.

H. Drop off/Pick-up: The customer agrees to provide clear access to the container for the purposes of loading and unloading the container onto the truck. If not accessible, the Customer agrees to pay a trip charge of $50. If the driver waits for a duration greater than 15 minutes, there will be an idle charge of $25 for the additional 15 minutes for the wait time. The customer also agrees to pay for any overweight fees after the container has been picked up.

I. Customer Care of Equipment: If a container is damaged by the customer, their agents, or third parties while in the customer's care, customer agrees to pay reasonable repairs to the container. If a collection action is required, the customer agrees to pay all collection costs including attorney's fees.
